Terms of Service

1. Acceptance of Terms

By accessing or using the DynaCargo platform operated by Dynamic Cargo Services Limited ("DynaCargo", "we", "us", or "our"), including the website at dyna-cargo.com and any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that contain inaccurate or misleading information.

4. Use of the Service

Permitted Use

The Service is provided for legitimate logistics, transportation, and warehousing business purposes. You may use the Service to list trucks, post loads, find warehousing, connect with other businesses, and manage your logistics operations.

Prohibited Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Post false, misleading, or fraudulent listings or information
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to other accounts or systems
• Scrape, harvest, or collect data from the Service without permission
• Use the Service to transmit spam, malware, or other harmful content
• Impersonate any person or entity
• Circumvent any access controls or security measures

5. Subscriptions and Payments

Certain features of the Service require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees as described at the time of purchase
• Subscriptions renew automatically unless cancelled before the renewal date
• Fees are non-refundable except as required by applicable law or as expressly stated in our refund policy
• We may change pricing with reasonable notice to existing subscribers

6. Listings and Transactions

DynaCargo provides a platform for connecting transporters, logistics companies, and businesses. We are a marketplace facilitator and not a party to any transaction between users. You acknowledge that:

• You are solely responsible for the accuracy of your listings and the fulfillment of any agreements made through the Service
• DynaCargo does not guarantee the quality, safety, legality, or availability of any listed services or goods
• Any disputes between users should be resolved directly between the parties involved
• DynaCargo may, but is not obligated to, assist in resolving disputes between users

7. Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by Dynamic Cargo Services Limited and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

By posting content on the Service (such as company profiles, listings, or images), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating and promoting the Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied
• DynaCargo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability for any claims arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim
• We do not warrant that the Service will be uninterrupted, error-free, or completely secure

9. Indemnification

You agree to indemnify, defend, and hold harmless DynaCargo, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination:

• Your right to use the Service will immediately cease
• Any outstanding fees remain payable
• Provisions that by their nature should survive termination will remain in effect (including limitation of liability, indemnification, and governing law)

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Zambia. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Zambia.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
